What are the real options when a broker owner wants to step back?

Sell, if a buyer will pay what the business is worth to you. Merge, if a larger firm wants your agents and you are fine with its name on the door. Close, if the people can land on their own. Hand it off, if someone inside wants it. Handing off fails more often than owners expect, because the successor has to become broker of record, carry the errors and omissions exposure, and run compliance. Many want the people. Few want the liability. The fifth option solves that: the team keeps its name and its culture, and a national brokerage carries the license, the files and the compliance. What makes a handoff hard is the part nobody wants: broker of record. Your successor takes on the errors and omissions exposure, the compliance calendar, the audits and every question a file raises once the office has emptied. Plenty of people inside a brokerage want the agents and the reputation; very few want that. Moving the group to a national brokerage separates the two. The license, the files and the compliance sit with the brokerage, the team name and the culture stay with the leader you pick, and the agents keep the relationships they have. Your attorney should read the plan first, particularly where a mortgage, title or escrow business is attached.

What happens to my agents if I close my brokerage?

Each agent has to find a new sponsoring broker, usually at short notice, and they rarely land in the same place. The relationships you built split across several firms. Moving the whole group to one platform before you close is how the people stay together.

A closure sets a date, and every agent has to be sponsored somewhere by it. In practice they ask the people they trust, get different answers, and land in four or five different firms. The group you spent years assembling stops being a group. Texas advertising rules decide the shape of it: the brokerage's name has to appear, and a team name appears alongside it rather than instead of it. That is why team names at Real are shown with Real Broker, LLC. What carries over is what the name stands for to your agents and your past clients, which is the team, its people and the way it works. What does not carry over is the license behind it. Ask your attorney how the entity, any trademark and your existing agent agreements are treated before the name moves, because those are three separate questions with three separate answers.

What happens to my mortgage or title company if I join a brokerage?

It depends on how it is licensed and owned, and this is a question for a licensing attorney, not a web page. What we can do is walk you through the questions other owners have asked counsel, so your first meeting with your attorney is a short one.

The answer turns on how the affiliated business is licensed, who owns it, and what agreements it holds with the brokerage. Some arrangements survive a move untouched, some have to be restructured, and some are tied to the brokerage entity closely enough that unwinding them is the whole project. None of that is decidable from a web page, and a wrong answer is expensive.
