What Happens to Your Clients, Database and License When Your Team Leader Steps Back

Who holds your clients' agreements once the team leader steps back?

The broker does. In its FAQ by category, TREC describes a listing agreement as a private contract between the property owner and the broker, with the sales agent outside it. TREC's team name FAQ puts a buyer representation agreement on the same footing: the parties are the buyer and the broker.

A team leader stepping back leaves those agreements with whichever broker signed them. The first thing to pin down is who that broker is after the change, and whether that broker still sponsors you.

TREC's rules and laws FAQ notes that a buyer may ask to be released from a buyer representation agreement. That request is the buyer's to make.

What does the change mean for your license?

TREC's team name FAQ ties a sales agent's work to the sponsoring broker: you may work only for the broker who sponsors you, and never for another broker or out of another broker's office.

The license also has to stay active. According to TREC's rules and laws FAQ, negotiating a transaction between third parties takes an active license, and brokerage activity on an inactive license is a violation that can bring sanctions.

If your business address or phone number changes with the team, TREC's article on recent broker changes requires every license holder to give TREC both, and they appear publicly in its online license holder search.

Who controls the team name you have been selling under?

The broker registers it. TREC's team name FAQ lets a sales agent advertise with a name containing Team or Group only when the ad also carries the broker's name and the broker has registered that name with the Commission.

TREC's FAQ by category goes further: any name a sales agent uses, apart from the licensed name or a registered alternate, is treated as a team name and has to meet TREC's team name requirements. The name on your signs and ads is a question for the broker as well.

Are you still paid for work done before the change?

Under Commission Rule 535.3, compensation can come to you through either your current sponsoring broker or the broker who sponsored you when you earned the right to it, according to TREC's article on recent broker changes.

TREC's FAQ by category gives the same answer with a condition attached: your license had to be active when you did the brokerage activity.

Who keeps the database you built?

TREC's rules on who holds the work speak to listing agreements and buyer representation agreements, and both sit with the broker. Your contact list and your sphere of past clients are a different asset, so ask your team for its terms on them in writing.

Am I still paid on deals I earned before my team leader stepped back?

Yes, within the terms TREC sets. Its article on recent broker changes says Rule 535.3 lets compensation reach you through your current sponsoring broker, or through the broker who sponsored you when you earned it. TREC's FAQ by category confirms that payment can follow you as long as your license was active when you did the brokerage work. Work done on an inactive license falls outside that answer.

For each file, list which broker sponsored you on the date you earned the right to the compensation. That broker, or your current sponsor, is the channel TREC's rule names.
